As owner and broker of 5th Avenue Realty there is more personal flexibility with how commissions can be credited since there is not any approval process with upper management or any corporate by-laws to adhere to that may prohibit this incentive.
The builder will be provided a copy of the signed commission credit agreement and the credit will be on the settlement statement prior to closing.

Registration as your broker is required with every builder. This registration is typically required prior to visiting the community. Having done this for 18 years (as of 2026), the very basic answer is negotiating. There is the assumption that if the builder doesn't have to pay an outside realtor/broker 2% or more, they will pass this savings onto the buyer. It simply does not work this way. Builders have that cost built into the price already. The realtor/agent for the builder retains a higher percentage to start. Second, the builder will never give a flat 2% or 3% back to the buyer for coming in without outside representation. It would create a firestorm for the whole industry as builders rely on general realtors and brokers to bring them buyers. If they lost realtors and brokers sending them potential buyers, it would cost way more money than the 2%+ they pay to realtors and brokers.
